The writ in this case runs to the board of equalization of taxes of New Jersey, to remove its judgment affirming the decision of the Essex county board of taxation, which, upon appeal to it, confirmed a tax assessment for the year 1907 made and levied against the prosecutor, the Fidelity Trust Company.

From the agreed facts in the case it appears that the trust company is a corporation existing under the laws of New Jersey with its office in the city of Newark; that on the 20th day of May, 1907, its capital and accumulated surplus *129amounted…
