The background of the case is as follows: The defendant was arrested on July 22, 1959 and charged with a violation of section 986 of the Penal Law. He was tried without a jury September 22, 1959 and found guilty. The defendant appealed the conviction to the Schenectady County Court which reversed the conviction on January 26, 1960 (20 Misc 2d 846). Then the People appealed to the Court of Appeals which reversed this court on November 17, 1960 and directed a retrial in Police Court (8 N Y 2d 333).
