Nichols, Justice.
Harry Lee Farmer was convicted of murder with a recommendation of mercy. Thereafter, his amended motion for new trial was overruled and the present appeal filed.
*365The first enumeration of error complains of the failure of the trial court to grant a continuance after the State announced ready and at the same time stated that its medical expert, who would testify as to the cause of death, would not be available until later in the trial.
