Plaintiff, an inmate confined in the Texas Department of Corrections filing pro se and in forma pauperis, brought this action for violation of civil rights against a captain in the Narcotics Service of the Texas Department of Public Safety. Plaintiff’s complaint is based upon events that occurred on or about August 24, 1972. Defendant has filed a Motion to Dismiss, asserting that plaintiff’s claim is barred by the applicable section of the Texas statute of limitations, Article 5526, Tex.Rev.Civ.Stat.Ann. (1958).
