The original plaintiff, Daisy Kohlhaas, claimed she was injured in an automobile accident on December 30, 1959. She filed this suit under the Dram Shop Act, Ch 43, Ill Rev Stats Sec 135, against defendant, Sam Morse, as a dram shop operator. Her suit was filed in apt time, and thereafter a motion was filed in the pending ease asking leave to file an amended supplemental complaint, and tendering such a complaint.

The purpose was to add as an additional plaintiff, Delores L. Bingel, executrix of the Estate of Merle Bingel, deceased, allegedly involved in the same collision; also to add certain…
