This case has been submitted under an agreement entered into in accordance with rule 59 of the rules of this court. The statement of the case as agreed upon is as follows:

“1. The suit was instituted June 5, 1889. The pleadings consisted of appellant’s original petition and appellee’s original answer. The original petition was in the usual form of an action of trespass to try title. The answer contained a plea of not guilty, a plea of ten years limitation, and a plea of long use by defendant as a street, and a plea of dedication for street purposes. The cause was…
