We granted certiorari to review Hyland Hills Park & Recreation District v. Denver & Rio Grande Western Railroad Co., 850 P.2d 155 (Colo.App.1992).
Petitioner Hyland Hills Park and Recreation District (Hyland Hills) is a quasi-municipal corporation and governmental subdivision of the State of Colorado created in 1955 pursuant to the 1955 Metropolitan Recreation District Act (MRDA).
