The parties to this action, formerly husband and wife, were divorced in the State of Washington on March 27, 1928. The decree of divorce contained no provision for the support of the wife apparently because, on November 2, 1927, while living separate and apart, the parties had entered into a written agreement the provisions of which will be hereafter referred to. It is upon the effect of that agreement, as modified in certain particulars on October 28, 1929, that this controversy depends.
