JUDGMENT DENYING PETITION FOR WRIT OF HABEAS CORPUS

VIETOR, District Judge.

This matter is before the court on a petition for writ of habeas corpus filed pursuant to 28 U.S.C. § 2254.

The action was referred to the Honorable R. E. Longstaff, United States Magistrate for the Southern District of Iowa, pursuant to 28 U.S.C. § 636(b)(1)(B), to conduct an evidentiary hearing and to submit a report and recommendation.
