In this action the appellant, who was plaintiff below, sought to recover damages for personal injuries resulting from the alleged negligence of the appellee. At the close of the introduction of appellant’s evidence, the appellee moved the court for a directed verdict. The motion was sustained by the trial court, and the legal justification for its action is the only question presented for determination.
