WEBSTER, Circuit Judge.

In this appeal we review the determination by the District Court 1 on remand 2 that, because it lacked subject matter jurisdiction to hear a federal claim, it also lacked jurisdiction to hear a pendent state claim.

Appellant Kuhn was employed as a janitorial employee by the United States Post Office Department. In August 1970, he received a letter from the Depártment notifying him that it intended to take disciplinary action against him.
