Simmons, Justice.

The plaintiff sued the railroad company for $500, on account of damages to certain furniture shipped over its line, and obtained a verdict for $225. On the trial the defendant introduced in evidence, as an admission of the plaintiff as to the amount of damage, his letter to an agent of the defendant, setting forth his claim, in which he said, “$100 will not do more than cover the loss, and I hereby make claim for this amount.” In regard to this testimony the court charged the jury as follows: “ Admissions are to be scanned with care.
