delivered the opinion of the Court.

In December 1951, Enrique Rodriguez filed in the Ponce Section of the former District Court a suit for divorce, against his wife, Carmen C. Albizu on the ground of desertion. The defendant filed no timely answer and her default was entered. Thereafter the defendant filed an answer denying the charge of desertion, and also a counter-claim alleging cruelty and grave offenses on the part of her husband.
