NOBLE, Justice.

Jack Adams Construction Company, Inc., (hereinafter termed Adams), primé contractor for the construction of some ten miles of four-lane concrete highway, sued its subcontractor, C. R. Davis Contracting Company, Inc., (hereinafter termed Davis)1, for damages occasioned by Davis’ failure to complete its subcontract within the time required by the contract.
