This is a CPLR article 78 proceeding by which the petitioners, a group of contractors and their trade association, seek to prevent the respondents City and related entities from advertising, awarding or registering some 20 or so contracts for public infrastructure work on the grounds that the contracts contain an illegal specification, namely “Section U”. Empire City Subway Company, Limited, New York Telephone Company and Consolidated Edison have sought to intervene and that application is granted.
