The plaintiffs Ruane, a jockey, and the Jockeys’ Guild, Inc. (“Guild”), a national association which represents the interests of member jockeys, bring this civil rights action against the New York State Racing and Wagering Board (“Board”) and the Board of Stewards 1 pursuant to 42 U.S.C. § 1983. The complaint requests monetary, declaratory, and injunctive relief because of certain state statutes and rules relating to the running of New York race tracks and actions taken pursuant to those statutes and rules.
