Appellees sued the appellant and the Gulf, Texas & Western Railway Company for damages to a shipment of furniture delivered by them! to the Gulf, Texas & Western Railway Company at Megargel, Tex., consigned to them at Donna, Tex. There was no pleading filed by the Gulf, Texas & Western Railway Company, and it was dismissed by appellee without any objection. The case was tried by the court upon an agreed statement of facts, and the court rendered judgment in favor of appellees, for the sum of $500.
