Appeal from trial term, Westchester county. Action by William H. Hoggett against the city of Mt. Vernon. From a judgment for plaintiff, and an order denying a new trial, defendant appeals.

This action was brought to recover for services alleged to have been rendered by the plaintiff as an inspector of the work of improving one of the highways of the defendant. It appears that the plaintiff was appointed or employed by the commissioner of public works of the city of Mt. Vernon as an inspector of certain street improvements, the plaintiff claiming that he was appointed for the time necessary to complete the work.
