Appeal from Jones District Court. Prior to February, 1859, the Dubuque and Pacific Railroad Company, being unable to agree with the plaintiff for a right of way for their road over certain lands of the plaintiff, procured a jury to be impanneled under the act of 1853 (Revision, §§ 1314-1331), and the damages assess^ ed. The plaintiff not being content with the assessment so made, appealed to the District Court of Dubuque county.
