This is a writ of error to the circuit court of Fayette county, to reverse a judgment of conviction, at its last February term, against plaintiff in error, for the crime of an assault with intent to commit murder. It was proved by the prosecution, and not denied by the defendant, that on the 31st day of December, A. D. 1892, he was married to the prosecuting witness in the city of Peoria, where he lived with her about two months, when they separated.
