OPINION

BAILEY, Judge (Specially Assigned):

Appellant, Frank Chase, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Tulsa County, Oklahoma, Case No. CRF-70-1216, for the offense of Carrying a Firearm, After Former Conviction of a Felony. His punishment was fixed at ten (10) years imprisonment, and from said judg*172ment and sentence, a timely appeal has been perfected to this Court.
