The accounting executor is also the sole legatee under the will. Objections to his account have been interposed by the Commissioner of Social Services of the City of New York, based upon the rejection of the claim of the department in the amount of $5,348.28. The hospitalization of the decedent, the time period, and the applicable rates are not *512disputed.
