COBEY, J.

Ezell Millard appeals from a judgment (order granting probation) following his being found guilty of possession of marijuana after a trial to the court. The primary basis for the appeal is appellant’s contention *761that the marijuana introduced into evidence against him was obtained by the police by means of an unconstitutional search and seizure.

We agree and reverse.1
