The defendant employed Mulchy as assistant manager of a district, including the city of Saratoga Springs and outlying territory. His duties were stated in a written contract, and included the employing and instructing of agents, inspecting, soliciting insurance, collecting premiums, and generally promoting the company’s business, and the giving of his time to that work to the exclusion of other business.
