This was an action of ejectment in the Knox Circuit Court, brought by T. Judson Hale against Daniel Paullin, to recover the possession of a, certain tract of land in that county.. The-cause was tried at the February Term, 1866, and resulted in a verdict for the plaintiff, that he was seised in fee of the premises in controversy. A motion for a new trial was made by the defendant, which was overruled, and exception taken, and judgment entered on the verdict, from which judgment Paullin appeals to this court, and assigns for error the refusal of the court to give instructions asked by him,…
