The plaintiff in error Lauro Garcia, hereafter designated as the defendant, was convicted of murder in the first degree. The. jury fixed his penalty at death. The deceased, C. E. Brockman, was a police officer of the City of .Fort Collins, and it stands admitted that the shot fired by the defendant was the cause of his death. One of the defenses interposed was insanity.
