Appeal from a judgment of the County Court of Chemung County (Monroe, J.), rendered March 4, 1983, upon a verdict convicting defendant of the crime of promoting prison contraband in the first degree.

After a jury trial, defendant, an inmate at Elmira Correctional Facility, was convicted of promoting prison contraband in the first degree as the result of his possession of a 13-inch metal rod with a sharpened end called a “shank”.
