At the close of all the evidence in the case the defendant requested the court to instruct the jury to find the defendant not guilty. The court refused the instruction and the defendant excepted, and the ruling of the court on the instruction is the only error relied upon to reverse the judgment.
It may be conceded, as stated in the argument of counsel for appellant, that in order to recover it must appear from the evidence that at the time of the accident plaintiff was in the exercise of ordinary care and that the defendant was guilty of negligence which was the proximate cause of the injury.…
