The appellee was indicted for the offense of giving spirituous liquor to a person under twenty-one years of age, in violation of section 9 of article 35 of chapter 29 of the General Statutes. The evidence showed that Davis, the appellee, and Rison, the person to whom it was charged that he gave the liquor, were aged respectively sixteen and seventeen years; that, desiring to purchase some whisky, each furnished a part of the money; and the appellee, in the absence of Rison, pro*241cured whisky, and when they met on the next day. gave some of it to…
