Memorandum: Defendant appeals from a judgment convicting him of two counts of assault in the second degree (Penal Law § 120.05 [2]) and one count each of kidnapping in the first degree (Penal Law § 135.25 [2] [a]), unlawful imprisonment in the first degree (Penal Law § 135.10) and rape in the first degree (Penal Law § 130.35 [1]).
