The defendant John Omo was found guilty by a jury of the offenses of burglary in the second degree (K. S. A. 21-520), larceny in connection with a burglary (K. S. A. 21-524) and possession of a pistol after having been convicted of grand larceny (K. S. A. 21-2611).

Upon notice and proof of a prior conviction of a felony, the habitual criminal act was invoked as to the convictions of the first two offenses; upon the burglary charge defendant was sentenced to confinement in the penitentiary for a period of not less than ten nor more than twenty…
