— In September, 1926, tbe appellant, being the owner of a Hupmobile automobile, made an agreement with the agent for that make of automobile in Seattle, the Sunset Motor Company, a corporation, whereby he was to purchase .a new car, and the corporation was to accept his old car at a price of $950.
