REGAN, District Judge.

This action was instituted on May 11, 1961, by plaintiff, Gang-Nails Sales Co., Inc. Subsequently, Automated Building Components, Inc., was substituted as plaintiff herein. There is no question in the case at bar that the substituted plaintiff is the assignee of the entire interest of U. S. Letters Patent No. 2,-877,520 hereinafter referred to as the Jureit Patent. Plaintiff seeks an adjudication that Claims 1, 3, and 4 of the Jureit Patent are valid and have been infringed by the defendant.
