This is an information in the nature of a quo warranto. The relator Livesay claims the office of district attorney for the first judicial district by virtue of an election to that office at the general election held November 8, 1881. and presents his certificate of election, signed and sealed by the secretary of state. The defendant Wright claims the office by virtue of his appointment by O. O. Carpenter, judge of the first district, to fill a vacancy occasioned by the resignation of Harper M.
