Reversing.
The appellant lias prosecuted this appeal from a judgment of the Hickman circuit court sentencing him to the penitentiary for a period of one year under an indictment charging him with the crime of hog stealing. In the motion and grounds for a new trial a number of alleged errors are assigned, among which is that the evidence is insufficient to sustain a conviction, hence, the court erred in refusing to sustain appellant’s motion to peremptorily instruct the jury to find appellant not guilty.
