Ingraham, J.:

The widow and children of the decedent, Ferdinand Hirsch, presented a petition co the surrogate alleging that the said Ferdinand Hirsch died on the 13th of July, 1901, leaving a last will and testament, which left substantially all his estate to his executors, in trust, for certain purposes specified in the will. The will appointed one of the petitioners, Minnie F. Hirsch, the widow of the deceased, and Edward K. Jones executors and trustees.
