Appeal from an order of the Family Court of Broome County (Hester, J.), entered December 24, 1996, which granted petitioner’s application, in a proceeding pursuant to Family Court Act article 3, to adjudicate respondent a juvenile delinquent and placed him in the custody of the Division for Youth.
Following a fact-finding hearing, respondent was found guilty of committing an act which, if committed by an adult, would constitute the crime of assault in the third degree and, accordingly, was adjudicated a juvenile delinquent. A dispositional hearing was held after which Family Court placed…
