John P. Turner (Turner) appeals from the Eighteenth Judicial District Court’s order dismissing his complaint against the engineering firm of Kerin & Associates and against civil engineer Richard Kerin (jointly referred to as Kerin) for failure to state a claim upon which relief can be granted pursuant to Rule 12(b)(6), M.R.Civ.R We affirm in part, reverse in part and remand.

We restate the issues on appeal as follows:
