The Board of Directors of the North Pocono School District has filed preliminary objections seeking to dismiss this mandamus action which has been brought by the Superintendent of Schools for the North Pocono School District. Plaintiff Louis V. DeFazio asserts that the board failed to comply with the mandatory provisions of the Public School Code of 1949 in the manner in which it declined to renew his contract for another term.
