Order unanimously modified on the law and as modified affirmed, and matter remitted to Supreme Court for further proceedings on the fourth count of the indictment, in accordance with the following memorandum: Upon inspection of the minutes of the Grand Jury, Supreme Court dismissed the indictment of defendant charging him with two counts of grand larceny by false pretenses and two counts of grand larceny under Lien Law § 79-a.
