—Appeal by the *535People from (1) an order of the County Court, Suffolk County (Cacciabaudo, J.), dated April 1, 1999, which granted the defendant’s motion to dismiss the indictment, and (2) so much of an order of the same court dated May 18, 1999, which, upon reargument, adhered to the prior determination.
Ordered that the appeal from the order dated April 1, 1999, is dismissed, as that order was superseded by the order dated May 18, 1999, made upon reargument; and it is further,
