Action by the plaintiff, as administrator, to recover from the defendant the value of twenty shares of stock alleged to have been a part of the assets of the estate, and alleged to have been converted by the defendant to his own use. Defendant demurred generally upon the ground that the complaint did not state facts sufficient to constitute a cause of action against him; and specially, for other reasons. The demurrer was sustained, and since the plaintiff elected to stand upon his pleading, the action was dismissed. Plaintiff has appealed to this court from the trial court’s judgment…
