ORDER
COVINGTON, District Judge.
This matter comes before the Court pursuant to the Eleventh Circuit Court of Appeals’ Order (Doc. # 20), remanding this appeal to the district court, which was filed in this Court on November 28, 2005.
The Eleventh Circuit’s Order requires that this Court vacate its July 21, 2005 Order that affirmed the bankruptcy court’s June 9, 2004 dismissal of Appellant Trustee’s appeal and also affirmed the bankruptcy court’s July 30, 2004 denial of Appellant Trustee’s motion for reconsideration and motion for extension of time to *791file an appeal.
