In this action of tort verdicts were directed for all of the defendants except David E. Mehlman, Junior, hereinafter called the defendant. The declaration contained three counts. The first count was for assault and false imprisonment, the second was for the malicious prosecution of a charge of drunkenness, and the third was for the malicious prosecution of a charge of operating a motor vehicle while under the influence of intoxicating liquor.
