This is an action at law brought in the district court for Douglas County by Raymond R. Cox, administrator of the estate of Shirley L. Cox, deceased, as plaintiff, against Daniel Babington, defendant. The purpose of the action was to recover damages for the wrongful death of Shirley L. Cox due to the negligence of the defendant in causing a collision between an automobile driven by him and an automobile ‘driven by the plaintiff’s mother in which the deceased was a passenger.
