This is an appeal from a decree entered upon the petition of the trustee under the will of George Tower instructing the petitioner that the residuary trust estate held by it under the will should be distributed "to those persons who would have been the next of kin and heirs at law of . . . [the testator] had he died on April 16, 1942.” That was the date of the termination of the trust. Herbert E.
