Early on the morning of January 11, 2005, Edward Contreras and an associate, Christian Santos, were shot in a grocery store at the corner of Sherman Avenue and West 204th Street in Upper Manhattan. Contreras died of his wounds several hours later. Santos, although seriously injured, survived. In March 2009, defendant, Oman Gutierrez and several others were indicted in connection with those shootings. As is here relevant, defendant and Oman Gutierrez were charged with first-degree murder (Penal Law § 125.27 [1] [a] [vi]). It was alleged that defendant…
