— This was a prosecution against Jackson Knight, the appellant, upon an indictment for an assault *376upon, with the intent to murder, one Nicholas Hampton. A jury returned a verdict of guilty, fixing the appellant’s punishment at a fine of one dollar and imprisonment in the state-prison for two years. A motion for a new trial being first overruled, judgment was rendered on the verdict. The trial was had at the September term, 1879, of the court below, and was concluded on the 20th day of September - in that year.
