Riner, Chief Justice.
The District Court of Weston County by an order duly entered overruled a general demurrer to plaintiff’s petition in a case wherein Albert L. Tavegia, also known as Albert Tavegia, was .plaintiff and J. R. Bromley as State Highway Superintendent of Wyoming was defendant. By the order overruling the demurrer the defendant was “given thirty days from the date of this order in which to answer or otherwise plead” to the petition aforesaid.
