The issues presented to the court upon this motion for the modification and confirmation, as modified, of the report of a referee taking and stating the account of an assignee, are those raised by the findings of the referee, and by the exceptions thereto: (1) of the claimant Mumford; (2) of the assignee, as the trustee for the general creditors, and (3) of the class of creditors referred to in the report and hereafter described as the “ Stock Exchange creditors.” In support of the exceptions to the *266report filed by the claimant Mumford, no reasons were formally presented and no authorities…
